This Agreement is made between Pick and Padel (the “Club”), its subsidiaries, affiliates, and any other businesses or entities that operate on or rent/borrow space from the Club at its location(s) (“Associated Entities”), and the undersigned participant (the “Participant”). For minors under 18, this Agreement must be signed by a parent or legal guardian who agrees to the terms on behalf of each minor listed below. By signing this document, the Participant (or parent/guardian) agrees that this waiver applies to all future visits and use of the Club’s facilities.

1. Assumption of Risk

I understand and acknowledge that participating in activities such as padel and pickleball at Pick and Padel and its Associated Entities involves inherent risks, including, but not limited to, physical injuries, strains, falls, and exposure to environmental elements. I (and/or my child/children, if signing as a parent/guardian) voluntarily assume all risks associated with use of the Club’s facilities, courts, and equipment.

2. Release of Liability

In consideration for the opportunity to use Pick and Padel’s facilities, on behalf of
myself, my heirs and next of kin, I hereby release, discharge, and hold harmless the Club, its owners, employees, instructors, agents, affiliates, and Associated Entities from any and all claims, liability, or causes of action resulting from any injury, accident, or loss that I (and/or my child/children) may experience while at the Club or participating in activities provided by the Associated Entities. This includes, but is not limited to, injuries or damages caused by equipment failure, misuse, or negligence by the Club, its representatives, or the Associated Entities.

3. Indemnification

I agree to indemnify and hold Pick and Padel and its Associated Entities harmless from any claims, lawsuits, or damages arising from my (and/or my child/children’s) actions or conduct while on the premises, including incidents involving other participants or third parties.

4. Medical Authorization

I confirm that I (and/or my child/children) am/are in good health and have no medical conditions that would prevent safe participation in padel or pickleball. In the event of injury, I authorize Pick and Padel staff or representatives of the Associated Entities to seek medical treatment on behalf of myself or my child/children, and I assume full responsibility for any related expenses.

5. Compliance with Club Rules

I agree (and agree on behalf of my child/children) to follow all rules and instructions provided by Pick and Padel staff and representatives of the Associated Entities. I understand that failure to comply may result in participation being revoked without refund.

6. Photo Release (Optional)

I give Pick and Padel and its Associated Entities permission to use photos or videos taken of me and/or my child/children at the Club for promotional purposes, including on social media, the Club’s website, or in advertisements.

7. Continuing Agreement

This Agreement is intended to apply each time I (and/or my child/children) visit and use the facilities at Pick and Padel or participate in activities conducted by the Associated Entities. I understand that I do not need to sign a new agreement each time, and this waiver remains in effect for all future visits unless I provide written notice to revoke it.

8. Acknowledgment of Understanding

I have read this Release of Liability and Hold Harmless Agreement, understand its terms, and agree to be bound by them. I am signing this document voluntarily with full knowledge of its significance. I am 18 years of age or older and mentally competent to enter this waiver.
